HazRespondr Identify — Tool-Specific Terms of Use

1. What This Tool Is

HazRespondr Identify ("Identify" or the "Tool") is a free, public, AI-assisted chemical-identification tool offered by HazRespondr LLC at hazrespondr.com/identify. Identify uses a large language model and a curated chemistry reference dataset to suggest possible chemical identifications based on user-supplied photos and text descriptions.

These Identify Terms apply in addition to the main HazRespondr Terms of Service (Section 8 "AI Features") and the HazRespondr Privacy Policy. To the extent of any conflict between these Identify Terms and the main Terms of Service as to use of /identify, these Identify Terms control.

2. Advisory Only — No Operational Reliance

IDENTIFY OUTPUT IS ADVISORY AND INFORMATIONAL ONLY. It is NOT a substitute for the Emergency Response Guidebook (ERG), manufacturer Safety Data Sheets (SDS), container labels, primary chemical sensors, or qualified professional judgment.

The user agrees to:

• Verify every Identify output against authoritative primary sources before any operational use;
• Never use the Tool as the sole basis for personal protective equipment (PPE) selection, evacuation decisions, exposure records, or any life-safety action;
• Treat low-confidence outputs (confidence < 0.7) as untrusted suggestions only.

3. No Warranty

The Tool is provided "AS IS" and "AS AVAILABLE." HazRespondr LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement. The Tool may produce incorrect, outdated, or hallucinated results.

4. Limitation of Liability

To the maximum extent permitted by law, HazRespondr LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Tool, including but not limited to personal injury, property damage, regulatory consequences, or operational mistakes. The user assumes full responsibility for verification and operational decisions.

HazRespondr LLC's total aggregate liability for direct damages arising from use of the Tool shall not exceed one hundred U.S. dollars (US$100).

5. No Privileged Relationship

Use of the Tool does not create any contractual, fiduciary, advisory, or professional relationship between the user and HazRespondr LLC.

6. Privacy

The Tool logs the input (photo digest + text), AI inference output, and metadata for audit and improvement. See the HazRespondr Privacy Policy. Anthropic, Inc. is a sub-processor for the Tool's inferences. Audit-log entries are retained per the retention schedule in the Privacy Policy (Section 6, Data Retention).

7. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Maryland, USA. Any dispute arising from use of the Tool shall be resolved in the state or federal courts located in Maryland.

8. Changes

HazRespondr LLC may update these Terms at any time. Continued use after a change constitutes acceptance.
